New law: Fast broadband for new homes from January

The Scottish Government has recently announced new legislation that will require all new build homes in Scotland to have faster broadband access starting from 1 January 2025. This move is in line with the government’s commitment to ensuring that every new home is equipped with gigabit-capable connections, with a maximum cost cap of £2,000 per dwelling. If a gigabit connection is not feasible, developers must provide the next fastest broadband option within the cost limit.

According to the government’s Programme for Government, this new requirement comes after a successful consultation with network operators and housebuilders. The majority of stakeholders welcomed the initiative, recognising the importance of fast and reliable broadband in today’s digital age.

For those unfamiliar with broadband terminology, internet speeds are measured in megabits per second (Mbps) or gigabits per second (Gbps). A gigabit-capable connection offers speeds of at least 1,000Mbps, enabling seamless online activities such as streaming, video conferencing, and gaming.

While gigabit connections are commonly associated with full fibre technology, they can also be delivered through cable (DOCSIS 3.1) and fixed wireless access. However, due to infrastructure and construction costs, providing gigabit-capable connections within the specified cost cap may not always be feasible. In such cases, developers can seek exemptions by obtaining two additional quotes from network operators that exceed the cost limit.

Richard Lochhead, the Minister for Business, emphasised the importance of connectivity in modern society, stating that access to fast broadband is no longer a luxury but a necessity. Whether for remote work, education, healthcare, or accessing public services, reliable internet connectivity is crucial for individuals and businesses alike.
